1.    Services Provided
My LA Landscaping LLC (“Contractor”) provides a comprehensive range of landscaping and property maintenance services, including but not limited to lawn care, irrigation systems, snow removal, tree care, decking, plumbing services, and concrete work (“Services”). The specific scope of Services will be detailed in individual service agreements.
2.    Payment Terms
Payment for services must be made as outlined in the service agreement or Fee Specification. Payments are due upon completion of the service or as otherwise agreed. Late payments may incur a late fee of 15%. Prepayments for seasonal or subscription services (e.g., snow removal, aeration) are non-refundable unless otherwise stated.
3.    Changes to Services
Any modifications to the scope of Services must be agreed upon in writing. Additional services requested outside the original agreement will be charged at the rates specified in the updated service agreement.
4.    Duration and Termination
This agreement will remain in effect for the duration specified in the service contract unless terminated earlier. Either party may terminate this agreement by providing thirty (30) days’ written notice. In cases of early termination, refunds for prepaid services will be issued on a pro-rata basis for unused portions, less any outstanding balances.
5.    Equipment and Materials
The Contractor will provide all equipment and materials necessary for performing the agreed services. Any additional materials required beyond the agreed scope must be pre-approved by the Customer and may incur extra charges.
6.    Insurance and Liability
The Contractor maintains general liability insurance to cover potential claims related to services rendered. The Customer agrees that the Contractor is not responsible for damages resulting from unforeseen circumstances, improper use of provided materials, pre-existing property conditions, or any third-party interference.
7.    Employee Safety and Conduct
The Contractor is committed to ensuring employee safety and professionalism. Customers must provide a safe work environment and notify the Contractor of any known hazards. The Contractor reserves the right to refuse or suspend services if unsafe conditions are identified.
8.    Compliance with Laws
The Contractor operates as an independent entity and complies with all applicable local, state, and federal laws, including obtaining necessary permits and adhering to workmen's compensation regulations.
9.    Indemnification
The Customer agrees to indemnify and hold harmless the Contractor, its employees, and representatives from any claims or damages arising from the Customer’s negligence, failure to disclose relevant property conditions, or misuse of the Contractor’s services.
10.    Force Majeure
Neither party shall be held liable for delays or non-performance due to events beyond their control, including but not limited to severe weather, acts of God, strikes, or government actions.
11.    Dispute Resolution
Any disputes arising from this agreement will be resolved through mediation or binding arbitration in accordance with the laws of the State of Colorado. Each party is responsible for their own legal costs unless otherwise awarded.
12.    Suspension of Services
The Contractor reserves the right to suspend services for non-payment, breach of contract, or hazardous working conditions. Suspended services may resume once issues are resolved, subject to a reinstatement fee.
13.    Limitation of Liability
The Contractor’s liability for damages, whether in contract or tort, shall not exceed the total fees paid by the Customer for the specific service in question. The Contractor is not responsible for indirect, incidental, or consequential damages.
14.    Entire Agreement
This agreement represents the entire understanding between the parties and supersedes all prior negotiations or agreements. Any amendments must be made in writing and signed by both parties.
15.    Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Colorado.
16.    Acceptance of Terms
By engaging My LA Landscaping LLC, you (the Customer) agree to these Terms and Conditions in their entirety
